The Magistrate Court in Kasama has committed to the high court a 22 year old man for sentencing for defilement.

This is in a matter that was before the court for presentation of facts in which Chewe was convicted for defiling a child under the age of 16 contrary to Section 138 (1) of the Penal Code Amendment, Act No. 15 of 2005, and Act No. 2 of 2011 of the Laws of Zambia.
Particulars of the offence were that on January 29, 2025 in Kasama, Chewe had unlawful carnal knowledge of a juvenile under the age of 16 years.
And during the presentation of facts, Senior Public Prosecutor Aaron Kayula explained that the incident occurred on January 29, 2025, in Kasama.
He said the victim who is a juvenile from Amin Village went to Chaiwila Village around 10:00 hours to purchase fresh maize for resale and was dragged into the nearby bush and defiled.
Mr. Kayula said the juvenile screamed for help, but the accused covered her mouth with his hand and threatened to kill her if she continued to shout.
According to Mr, Kayula, the juvenile went home crying, and upon arrival, she informed her mother of what the accused had done to her.
He said her mother then reported the matter to TAZARA Police, and the victim was issued with a medical report.
He said acting on this report, police instituted an investigation that led to the apprehension of the accused.
He said during questioning, the accused revealed that he had carnal knowledge of the juvenile even after being fully aware that she was a child under the age of 16.
Mr Kayula said the accused later led the police to the scene of the crime, where photographs of both the accused and the location were captured.
He added that under the warn and caution statement, which was administered to the accused in Bemba, the language he understands well.
The accused then gave a free and voluntary reply, admitting to the charge.
When passing sentence, Magistrate Banda told the convict that the offence he committed is serious and carries a minimum 15 year sentence.
“The accused has been convicted as charged on his own plea of guilty. The offence you committed is serious and carries a minimum,” he said.
He then committed the convict to the high court for sentencing saying the case in question is beyond the lower court’s jurisdiction.
