Chisamba Magistrate Court has sentenced another couple of Mpamapamo area for one-year imprisonment with hard labour for trafficking in 10 grams of cannabis.
This is barely two days ago when a couple was imprisoned for trafficking in marijuana.
Before Resident Magistrate Susan Magalashi was Geofrey Azif Nkhoma and his Wife Mutomfya both aged 44 of Mpamapamo area in Liteta’s chiefdom in Chisamba who pleaded guilty to one count of trafficking in marijuana contrary to Section 15 (1) (2) of the narcotic drugs and psychotropic substances, Act Number 35 of 2021 of the laws of Zambia, as read with statutory instrument Number 119 of 1995.
ZANIS reports that particulars of the offence were that on 19th February this year, the accused jointly and whilst acting together did traffic in Psychotropic Substances namely marijuana, an herbal product of cannabis sativa weighing 10 grams without lawful authority.
Facts are that on material day around 02:45 hours, six Drug Enforcement Commission (DEC) officers led by Joseph Chilufya were deployed to Mpamapamo area after receiving a report that a couple was dealing in marijuana and found the suspected substance in the house of the accused.
Magistrate Magalashi found the couple guilty as charged and convicted them accordingly upon their own plea of guilty and admission of facts.
In mitigation Mutomfya appealed for leniency saying she has five children and she is 54also taking care of a child who is suffering from sickle-cell, while his husband added that they were taking care of his young brothers and if sent to jail, his family would suffer.
Having considered mitigation from a couple being the first offenders who did not waste the court’s time, Magistrate Magalashi sentenced Mutomfya to one-year simple imprisonment and Nkhoma her husband to one-year imprisonment with hard labour with effect from 27th of February 2025, but suspended their sentences for one year on condition that they should not commit a similar offence.
