MONGU MAN FINED K3000 FOR CAUSING DEATH BY DANGEROUS DRIVING

MONGU High Court has sentenced a 20-year-old male to a fine of K3000 for causing death by dangerous driving contrary to section 161 sub section 1 of the Road Traffic Act No.11 of 2002 of the laws of Zambia.

ZANIS reports that particulars of the offense are that Elias Mubanga of Nkeyema District in Western Province did cause the death of Cecilia Mununga Chitengi.

This happened on the 22nd of September, 2023 in Kaoma District of Western Province while driving a Toyota Corolla registration number ALD 2391.

Facts of the matter are that on the 19th of September, 2023, Elias Mubanga was driving on a public road namely, Boma road near Kaoma Secondary School in a manner which was dangerous to the public at the time 80-year-old pedestrian Cecilia Mununga the victim was walking on.

The victim was hit and sustained serious body injuries and was quickly rushed to Kaoma District hospital.

On the 22nd of September, 2023, the condition worsened and she died.

Meanwhile, in his mitigation, defense lawyer Mulafulafu told the court that the accused is a first offender and not wasted the court’s time.

“He is of youthful age with room to reform and also be more vigilant and reasonable when driving on public roads,” Mr Mulafulafu said.

He revealed to the court that the convict partially took responsibility for his action by contributing a sum of K3000 to the bereaved family.

Mr Mulaflafu added that at 20, the convict is still unemployed.

Judge John Mbuzi has since fined Elias a fine of K3000 to be paid by 28th January, 2025.

Justice Mbuzi added that if he defaults he will serve a sentence of eight months’ imprisonment.

He further ordered that his driver’s license be suspended for a period of six months.
