KASAMA HIGH COURT RESERVES RULING IN A MURDER CASE

THE Kasama High Court has reserved its ruling in the murder case involving a 52 -year -old man of Luwingu District in Northern Province.

The suspect Amon Masala is accused of killing his 40-year-old wife, Priscilla Mwaba.

Before Kasama High Court Judge Mathew Zulu was Amon Masala who is charged with one count of murder contrary to Section 200 of the Penal Code, Chapter 87 of the Laws of Zambia.

Particulars of the offense are that on March 13, 2024, Masala allegedly engaged in a fight with his wife after a drinking spree, resulting in her strangulation.

A Post-mortem examination was done and revealed that Priscilla Mwaba died from manual strangulation.

When the matter came up for commencement of defense, the Legal Aid team, led by Counsel Sola Kandeke, presented Patrick Kalubi, a general medical doctor at Kasama General Hospital, who testified on the findings of the post-mortem examination.

While, Dr. Kalubi confirmed the presence of manual strangulation and a severe degree of intoxication in the deceased’s bloodstream, he declined to conclusively determine the cause of death, stating that this would be for the court to decide.

With the testimony of Dr. Kalubi marking the close of the case, Judge Zulu reserved judgment for the March 2025 criminal session and set January 24, 2025, for final submissions by both the state and defense.

Masala had denied the charge and was committed to the High Court for trial by the Subordinate Court of the First Class, of Luwingu District.
